Terms of Service

Agreement

These Terms of Service are an agreement between you and Common Grounds at Leakey Drug for use of the ordering website, mobile app, account features, pickup ordering, loyalty features, and related services.

By creating an account, placing an order, using checkout, or enrolling in loyalty, you agree to these terms and our Privacy Policy.

Eligibility and Accounts

• You must provide accurate account, contact, order, and payment information.
• You are responsible for keeping your login credentials secure and for activity on your account.
• The service is not intended for children under 13. If you are under the age of majority where you live, use the service only with a parent or guardian.
• We may suspend or restrict accounts when reasonably necessary for fraud prevention, security, chargebacks, misuse, or legal compliance.

Pickup Orders

• Orders are for pickup at Common Grounds at Leakey Drug unless the app clearly states otherwise.
• Menu availability, prices, taxes, discounts, tips, pickup times, and inventory can change. Final totals are calculated during secure checkout.
• Special instructions and item notes are requests, not guarantees. We may be unable to satisfy every request.
• You are responsible for reviewing your cart, pickup timing, and contact information before checkout.
• If an item becomes unavailable, we may contact you, adjust the order, cancel the affected item, or refund the affected amount where appropriate.

Payments and Square Checkout

Payments are processed through Square-hosted checkout. Common Grounds does not collect or store full payment card numbers, CVV codes, or full wallet credentials. Square may present its own terms, payment options, buyer verification, privacy notices, or receipt options.

You authorize Square and Common Grounds to process the payment, taxes, tip, discount, loyalty redemption, and related transaction records needed to complete your order.

Cancellations and Refunds

Contact the store as soon as possible if you need to cancel or change an order. We may not be able to cancel or change an order after preparation has started.

Refunds, partial refunds, substitutions, and credits are handled case by case, consistent with applicable law, Square processing rules, and the status of the order. Processing times can vary by payment method and financial institution.

Loyalty and Rewards

Loyalty points, punch-card rewards, discounts, and promotions may be managed through Square and may change, expire, or become unavailable. Rewards have no cash value unless required by law.

Messages and Notifications

You may receive transactional emails, SMS messages, push notifications, or account messages related to authentication, order status, pickup, receipts, loyalty, account security, and support. Message and data rates may apply for SMS. Reply STOP to opt out of SMS where supported.

Promotional SMS or marketing emails should only be sent if you have separately opted in or if permitted by law, and those messages must include required opt-out instructions.

Food, Allergens, and Availability

Menu descriptions, ingredients, images, and availability are provided for convenience and may change. Food and drinks may contain or come into contact with allergens, including milk, eggs, wheat, soy, tree nuts, peanuts, and other allergens. Tell staff directly about allergies or dietary needs before ordering.

Acceptable Use

• Do not misuse the service, attempt unauthorized access, interfere with checkout, scrape excessive data, reverse engineer protected systems, or use the app for fraud or unlawful activity.
• Do not submit abusive, false, harmful, or unlawful content in names, notes, support requests, or order instructions.
• We may rate limit, block, suspend, or refuse service when reasonably necessary to protect customers, staff, vendors, systems, or the business.

Third-Party Services

The service depends on third-party providers, including Square, Supabase, Vercel, Apple, Google, SMS providers, and app-store platforms. Their services may be governed by their own terms and privacy policies. We are not responsible for third-party systems outside our reasonable control.

Disclaimers and Limits

The service is provided on an as-is and as-available basis. We do not promise uninterrupted service, error-free operation, constant menu availability, or that every pickup estimate will be exact.

To the fullest extent permitted by law, Common Grounds will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the service.

Governing Law

These terms are governed by the laws of Texas, except where consumer protection law requires a different rule. If a dispute cannot be resolved informally, it will be handled in the courts with proper jurisdiction, unless applicable law requires otherwise.

Changes

We may update these terms as the app, vendors, laws, or business operations change. Continued use of the service after changes means you accept the updated terms.
